Legal Question in Criminal Law in Georgia
will i ever be able to purchase a firearm after being convicted of family violence back in 2000.
1 Answer from Attorneys
Because of the seriousness and prevalence of domestic violence in our community our state and federal government enacted touch laws on those convicted of an offense. One such penalty is the ban on gun possession.
Although the ban on owning or possessing a gun after a domestic violence conviction is indefinite, those convicted may petition the court to restore their right to carry a firearm. Obviously a period of time must lapse between the conviction and ultimate petition to carry a firearm, e.g. three to five years. During such time, the offender must have completed all of the conditions of the sentence, and the offender must not have any current criminal charges pending.
