Legal Question in Criminal Law in Georgia
Wrongly Accused By The Grand Jury!!
My brother was charged in 2001 for manufacturing meth which the state has had to dismiss due to no evidence. Now 2 people he knows have been arrested for trafficking meth and they have implicated him to the grand jury which had him arrested. One of the guys has just got out of fed prision for drug charges and we assume that he was mad cause his girlfriend showed interested in my brother. With 2 of them saying it was him and only him saying it wasnt what are his chances? He thinks he is going to jail for 60 years for somthing he had nothing to do with. Can the grand jury do such a thing and will he even be able to tell his side. I think the state is harrassing him

Re: Wrongly Accused By The Grand Jury!!
If you brother is going to be indicted by the Grand Jury, he needs to consult a criminal defense attorney immediately. He cannot under any circumstances make any statements to any law enforcement agency. Please call at (800) 313-9619 if you have any questions about this matter.
Re: Wrongly Accused By The Grand Jury!!
Normally an individual is not entitled to make an appearance before the grand jury. To obtain an indictment in most instances is very easily done. The real issue for your brother is to obtain competent representation to handle the case. If the case has not been indicted, it is particulary important for him to have representation now so that a motion for recording of the grand jury proceedings can be filed.
I have had some particular success in cases where the only witnesses for the state are testifying as a part of a plea deal.
Good luck to your brother.
