Legal Question in Discrimination Law in Georgia

discrimination and retaliation

When an employee is treated unfairly due to gender bias is that considered discrimination and creating a hostile environment? Once a complaint is made to the appropriate channels, is there any protection against retaliation?

gender bias and retaliation

Yes, if the difference in the way you are treated is as a result of your being one gender or the other, Title VII of the Civil Rights Act of 1964 as amended would cover it; and if you complain to the proper channels both in the company, and to the U.S. Equal Employment Opportunity Commission, presuming your company has enough employees to meet its jurisdictional requirements, the law would protect you against retaliation, even if you were wrong in the first instance about the treatment being discriminatory. Your state law, depending on what it is, might also cover you on both of the above. See a local attorney who is well versed in employment discrimination law.
