There is no general legal right to not be offended or subjected to a bad joke or something said in bad taste. Not every comment about skin color is "racist." Anyone can sue for anything (and often find a lawyer somewhere to handle it), but unless there is more to the story, this poor choice of words by a waitress is not going to rise to the level of unlawful discrimination and will not lead to a big check from Waffle House. You might consider addressing the matter to the manager.
