Disorderly conduct & DUI

My son was arrested for disorderly conduct,on the citation the officer wrote in bold,NOT DRIVING)when we went to court they had added DUI to the charges.Can they do that?what can we do?

Consider hiring an attorney to represent your son. Self defense is not a viable option when facing DUI charges that are likely to result in imposition of jail time and a mandatory fine.

If he wasn't driving or in control of the vehicle when stopped he should not be charged with DUI legally. Sounds like this may be a mistake.

Charges are often changed by the prosecutor once the officer turns the case over. Alot of factors will determine whether the charges are appropriate.
