In georgia, what is the typical sentence for a first time DUI offender who has refused sobriety testing?

It depends. Your best shot at beating a DUI charge is when the breathalyzer test was refused. Depending on the field sobriety tests, the charge can either be dismissed or reduced to a reckless driving.

The typical sentence for a 1st time DUI is 24 hrs jail (credit for time served), 40 hrs community service, $750 fine, drug/alcohol evaluation, counseling if needed, DUI defensive driving school, license suspension (with permit to drive to work).

The sentence is pretty mandatory, but there are ways to manipulate it to your best interest (for example, sometimes you can serve jail time in court instead of going to jail).
