Employment & DUI history
I had a Michigan drivers licence, but was given a DUI in Georgia. I now live in Colorado. In 1994 I was stopped on suspicion of drunk driving. They attempted to give me a breathalyzer and after the third attempt the machine registered a reading. I was arrested, etc. bailed out. I was given a 500.00 fine and one year probation. I have not had a ticked of any kind since then, not even a parking ticket. My problem is that every time I apply for a job I am asked if I have ever been arresed and if so give details. How long will this show up on my DMV record. Is it necessary to tell prospective employers about this since it was so long ago. If I decide not to devulge this to them, will they find out with a background check. They say on the app. that if you answer yes that this does not automatically bar you from employment, but lets face it, when they see a yes, this is probably how they breakdown probable employees. I have impecable job skills and jobs that I apply for have nothing to do with transporting or driving. What can I do if anything. Thanks

You've hit the nail on the head. Most likely they would not find it. Colorado only keeps a DUI on the public record for 7 years. If you apply to for a job with someone who has access to criminal records, such a as job that requires a security clearance, they might find it beyond the period it is on motor vehicle records. If you have to explain it, tell them there was no test.

Your criminal conviction for a DUI remains on your criminal record forever. Your driving record is something separate. If an employer asks, be honest. There are quite a few people out there these days who have a DUI conviction. You will find an employer who will still hire you. Good luck.
