Legal Question in DUI Law in Georgia

Need help getting license reinstated

My husband was convicted of his 3rd DUI in 1995 after a one car accident. The GSP did not take

the license and he never got a letter asking him to turn the license in. When trying to get

the license back, they are only giving him credit for time since the license expired in 1999.

Re: Need help getting license reinstated

If the license was confiscated at the time of the traffic stop, upon conviction, it should have been forwarded to the Georgia Department of Public Safety. If it was not confiscated at the time of the stop, it should be turned in when convicted. If you lost it, you should have filled out a lost license affidavit at the time of conviction. If any of the above apply, it might be possible to get a court order allowing credit for the suspension time.

If you simply retained possession of the license without turning it in, the licensing agency will not give you credit for the suspension time. If this is the case, you probably will not be able to receive credit for the suspension time.
