Legal Question in DUI Law in Georgia

Can you move out of state if you are on probation?

My husband and I were planning on moving to Indiana in 2-3 months to be close to family. In the past month he has 2 separate charges; 1.) a ticket for minor possession of marijuana and 2.) for a DUI and failure to maintain lane. We are assuming he will be put on probation. Will we have to stay in Georgia until he completes probation or can we still move as planned?

If both of these charges are misdemeanors, the private probation company cannot keep you from moving to another state. If one is a felony, you cannot move until probation approves the place you're going to and gives you a travel permit. Felony probation can be transferred if the new state accepts your case. It's complicated.
