The night before
If you are involved in an accident and the night before you had been drinking can you still be charged with a DUI through a blood test?

Re: The night before
In Georgia, if you are involved in an accident with serious bodily injury, or if the officer has probable cause to arrest you for DUI, he will request an official state test. In your case, he requested a blood test. If the blood test comes back positive for an unlawful blood alcohol level, or if it comes back positive for some other prohibited substance (drug), you can be charged with DUI. If you would like to read more information on the subject, you can do so at my website (www.duiguy.com) or you can send me more detailed information at www.duiguy.com/intake.htm.
