Auto contract fraud
Does injured party have legal recourse to void contract on auto contract purchase signed by incompentent 88 year old person
with no understanding and no ability to pay?

If truly incompetent and unable to handle their own affairs, such that a Judge would appoint a guardian, maybe. Just getting sucked into a bad deal they did not understand and did not seek help for, usually not. Ability to pay is rarely an issue since it is the purchaser's fault for agreeing to pay when they are unable.
