Legal Question in Family Law in Georgia

My 16 year old son lives with his father in Georgia and wants to move in with me. I live in Florida.

The child support case we had was officially closed, but originally, we were divorced in Washington State in 1996 and have joint legal custody. The father however, has always been the domiciliary parent.

I do not want child support. Can my 16 year old son simply move in with me against his father's wishes? What would happen if he just stayed here next time he came to visit?

He wants to go to school here in Florida.

Thanks.

Karen

Unless you want to risk ending up in jail, do not even think of violating a court order. The only way to change a court order is to get a new court order. See a lawyer in Georgia.

Your plan will likely get you a complete loss of custody, visitation, contempt order and a trip to jail.

A motion needs to be filed on your son's behalf to change custody. In Georgia, a 16 year old can make a decision on custody.
