15 yr old daughter wants to come back to live with me after 3 yrs with dad
My daughter has been living with her dad for 3 yrs and now wants to come back to me. He is against this and is making visitation very hard. We have recently sold our home and are staying with my motherin law. I need to know if this would stop a Judge from giving me custody. We do plan on buying a house in the next six months. I also had a nervous breakdown in december because my youngest daughter went to live with him. He is very controlling and emotionally abusive. He has also been verbally abusive to them both but lets them run wild. My youngest one is 13. I would also like her to come back, but he has to much control over her at this point.

Who gets custody would be decided by the judge after considering all the circumstances and determining what is in the best interests of the children. So, it would be impossible to say if one fact would prevent you from getting custody, but I can tell you that the environment in which you live will have an effect on the judge's decision.
