Is there a way I can become administrator of my late husbands estate without going through probate? All that is left is a house with a mortgage in both our names but without survivorship

All probate cases involve the probate court. There is no way to transfer the property without a court case.

However, it may be a BIG mistake to become an Adminsitrator, as other type probate filings may have an advantage. This is why a lawyer will save you money. There is at least one type filing which would not involve administration that could save you a whole year's property taxes.
