How to become an administrator of my son's estate

my 23 year old son was killed in an accident in atlanta, ga. i have his last check from his employer made out to him. How do I cash the check. how do i become administrator of his accounts

Consult with a local attorney. It may not be necessary to jump through the hoops to be appointed administrator.

TO become an administrator go to the probate court in the county where he lived and file a petition to become the administrator of his estate. Depending in his assets and debts it may not be worth filing. First you have to complete the paperwork, pay the filing and notice fees, then you may have to post a bond if he has property. As admnistrator, one of the first things you would have to do is pay off his debts. His paycheck may not cover them. If he was killed in an accident though, his estate may have a claim, depending on the facts in the accident. Consult with an attorney.
