Hello, my wife filed for stepparent adoption in Dec. 2006. My ex-wife has not seen my daughter since June 2005; she has not contacted her in any way at all. She also moved, stopped paying support and cancelled the Court ordered insurance in April 2006. We do not know where she moved to. We ran a newspaper add in her last known and here locally. We had a home study done and received a glowing recommendation from the guardian. We were suppose to go to Court March 27th and received a call from my attorney on the 26th saying that the Judge was taking it off the calendar. My lawyer said that the Judge is taking something from the divorce code, putting into ours and saying that we have to do it. He said that the Judge said we have to file a Motion asking to print the adds in the paper and submitt an affidavit stating what I have done to try to locate the mother. Moreover, the Jugde asked why I havent done a skip trace to find her. I dont get it!!!! I paid $500.00 for the paper adds and will likely have to do it again. My attorney says that there is nothing we can do. Why caint I ask for another Judge? Why isnt there a senior Judge that can review? What can I do? Before you can serve anyone by publication, you generally need an order for publication on the person from the judge. If your attorney messed that up (and that is a huge blunder, as even an inexperienced lawyer should know that), he should cover the cost of the ads.
