Legal Question in Family Law in Georgia
Adultery and child custody
I have been separated for 9 months and my husband is contesting the divorce and child custody. He has been trying to say that I am having an affair. He has no proof, because I am not. How could these accusations affect my custody. How long can he prolong the divorce becoming final? He is trying to reconcile, but he has had problems with several affairs and I cannot afford to get the proof and do not care to get the proof now.

Re: Adultery and child custody
Accusations without proof mean nothing in court; in fact, it will hurt his case. Judges don't like to hear unfounded allegations of an inflammatory nature.
As to how long he can prolong the divorce, that depends on the docket backup in your court. The clerk of superiot court may be able to give some advice.
I would suggest that you at least consult with a local attorney. Call around; many attorneys don't charge for initial consultations.
