Legal Question in Family Law in Georgia

Adultery and division of marital assets and bills

I plan to divorce my spouse on grounds of adultery. How do the courts look at division of marital assets and debts when adultery is involved? Our income is split at about 65/35, me earning the lesser. We were married 13 years and have 2 children. Should alimony come into play? Also, how is the % chosen when it comes to child support. I know the % falls between 23% and 27%. We have approximately 45,000.00 equity in the house and my spouse has a substantial 401K.

The adultery can be considered by the court as affecting the amount of alimony to be awarded if the adultery was prior to separation and was a cause of the break-up.

There is no formula for alimony like there is for child support. The amount of alimony awarded is whatever a judge or jury decides to award.
