Legal Question in Family Law in Georgia

Age of Consent/ Parental control after that age

My sis is 15 but about to turn 16 in february. Her boyfriend who she had sex with is 18 but he just turned that age in november. They had sex twice once before his birthday and once after. our parents know about all of it. and aren't pressing charges but have restricted her from being with him. when she turns 16 will she be able to be with him? sex? will they be able to press charges after her birthday for stuff that happened before? When is the legal age to leave the house? and if my sister is pregnant, (she is then considered as an adult) would our parents be able to press charges to her boyfriend? because if she is considered an adult with a child the boyfriend being the father could he be put in jail if our parents press charges? what is her legal stand point in this situation... please answer all questions as urgently as possible!

Re: Age of Consent/ Parental control after that age

In NY the age of majority is 21. The age when a girl can have sex with a male w/o subjecting him to potential statutory rape charges is 17. The Rape charges may be made w/in 3 years of the incident. Which means that even after the "age of consent" 17 rape charges can be brought against the male, since the Statute of Limitations may not have expired.

In the event of pregnancy, if both parent's are of like mind, the parent's may "wash their hands of the girl, and seek to exclude the girl and baby, from their home by legal or extra legal means. The parent's cannot be held responsible for the care and support of their child's child even if their child is underage.

If a person under 18 or 21 is self supporting and wishes to be emancipated from the authority and control of their parent's, the person may file a Petition in Family Court for emancipation. Where they must prove to the Court that they no longer require parental support, help or direction.

Good luck,
