Alimony & Child Support Arrears
My husband was out of work for 3 months due to a medical emergency and had 2 surgeries. We got behind on his child support for his 2 children. He has never missed a single week of paying the court ordered amount of $240 and even the alimony of $100 per week. Prior to the divorce in 2003, they were separated for 6 years. During those 6 years, he voluntarily paid her $400 per week plus some. He gave her money for a new engine for her car, had her dogs spayed, and even wrote her a check to have her hair done. For the first time, he is behind for a legitimate reason. She is irate that he remarried. We are trying diligently to get caught up and about $1,440 behind in child support alone. We have not even tried to attempt alimony at this time. He is no longer working the OT he was working. We have a court date 12/15 to modify the decree, however, until then what your your thoughts? Since he paid her SO much in the past will they make us backpay the alimony? We are getting the alimony dropped as part of our modification. We even attempted to get her to agree to a temporary reduction in child support but never heard from her or her attorney. We have tried everything. I have even borrowed money from work to pay her something.

Bring all your documents with you to court. Based on what you have said, I believe a judge would grant your petition to modify. However, I would strongly advise you to consult with a local attorney since the results of the hearing will have long-lasting effects.
