Legal Question in Family Law in Georgia
Alimony Modification
I was divorced 2+ years ago from a wife who seldom worked because she claimed to be in bad health. At the time of our divorce she had started to receive disability benefits from Social Security. We agreed to a set amount of alimony which amounts to approximately 30% of my pay. Since the divorce, she has started working, and I believe may have lost Social Security benefits. Is it possible to have alimony modified under these sort of circumstances? Is there any legal way to determine whether or not she is still receiving Social Security benefits?

Re: Alimony Modification
The real questions is, does she make more money than she did on social security. You can seek a modification of alimomy if there has been a substantil change in circumstances. The deciding factor is her need and your ability to pay. If her need is lowered, then so will your obligation for alimony.
