Amendment to divorce decree

If the father of a child does not exercise visitation can an amendment be filed for full custody of said child? Currently the father is claiming the child even though he lives with the mother. I want full custodial rights along with the right to claim my child.

You can certainly ask the court to modify custody rights. Consult with a local attorney.
