Assets are NOT always shared 50-50. Georgia has equitable division, so other percentages are possible.

Since your first premise is wrong, your second questioon as asked is unanswerable as there is no such rule.

If you are contemplating a divorce, you should speak with an attorney. Many people think that that assets are divided 50/50. As Mr. Ashman states, georgia is an equitable division, meaning that property will be divided in a manner that is equitable to both parties (not equal). Also the only property subject to equitable division is property considered marital property. Retirement funds sometimes fall in a gray area and you should speak with an attorney to get a better sense of your case.
