attaining custody
My husband would like to get joint physical custody of his two children. In the divorce decree, he had physical custody of the youngest and his ex-wife had physical custody of the oldest. They had joint custody of the other. She took him back to court last year and got temporary custody of the youngest. The final order stated that he was to get visitation every other weekend. His ex-wife has not let him see the children since March 28, 2004. He was out of work and got two weeks behind in his child support. She also is erratic about when she has let him have them for the past year. She will keep them even if it is his weekend if it suits her. Also, she has not taken care of them properly. Last year, both children got ringworm around July. She didn't take them to the doctor until September. The youngest child got glasses in June of last year. They broke around July. He didn't start wearing them again until January of this year. She had been living with a married man at the time, worked, got child support on time and her father lived with them. She never asked my husband for any help. My husband has witnesses to all of this, as well as video and photo evidence. He cannot afford an attorney.

If he cannot afford an attorney, there are a variety of Legal Aid organizations that may be able to help. In addition, Fulton County has a Family Law Center in the Fulton County Courthouse. You can go there and speak with an employee who can direct you to any proper forms and explain the procedure.
