Legal Question in Family Law in Georgia

Back Child Support

My exhusband owes me $14,500.00 in back child support plus he is still paying child support for one of our four children in the amount of $125.00 per month. I am having $300.00 payments deducted from his pay check twice monthly to get some of the money he owes his children.

He called me a couple of days ago asking if I would make a settlement with him in the amount of $10,000.00 and forgive him the remaining amount that he owes and if I would also

agree for him to stop paying child support for our youngest child. My question is ... if he can come up with $10,000.00, shouldn't he just pay me that anyway and continue to pay the remaining amount he owes? And, I also would like to know if it is possible to increase the amount of child support he pays now. Am I legally entitled to any extra money he has to get this past debit paid?

I appreciate your response.

Re: Back Child Support

Like you, I am suspicious about his motive in coming up with $10,000.00 and wanting to settle the matter for that. I would at least get him to put his offer in writing, thereby documenting his financial ability. I would then advise you to contact a local attorney who can fully investigate the situation. If you are in my area, please free to call.

Re: Back Child Support

There are a lot of issues involved in your questions. I will answer the questions that are clear. You can seek a modification of child support for the youngest child if the criteria for doing so is met. He is obligated to pay you the full of amount of child support owed that is past due. Please contact my office for further consultation on the matter.
