Legal Question in Family Law in Georgia

Any benefit to filing for divorce before moving to another state?

Husband and wife live in same state now (GA). Wife wants to move to another state. Is there any benefit to filing for divorce in GA before she moves, or are there any drawbacks of filing in GA after she moves out of state? She does not plan to file out of state.

You didn't state who it is that is that is considering filing. If it is the husband, he can subject her to the GA jurisdiction by filing before she moves. The same applies if it is the wife who files: she will be subject to the GA jurisdiction. Consult with a local attorney.

I'd need more facts to answer you. If you're agreeable now, it is probably better to deal with things now than to await future problems.

From a practical standpoint, there are many good reasons to file for a divorce once you know that you wish to have one. Furthermore, your legal fees and travel expenses will probably be less by doing so. Feel free to contact me if you want to initiate proceedings and want to know what employing legal counsel entails.
