Legal Question in Family Law in Georgia

If the biological father of my child has not legitimized her, nor signed the birth certificate, nor does she have his last name, and has not taken a DNA test that will hold up in court, can her step father without the biological fathers consent sign the birth certificate and legitimize her himself?
