Legal Question in Family Law in Georgia

Biological father wants to establish paternity

My son, (then 15), has a daughter, 3 1/2. The mother (then 18), at the urging of her parents, refused to allow him on the birth cert. Later she married. Her husband went down and signed as the father. I don't know how far this went as far as legitimizing or just signing the birth cert. They had 2 other kids and are now split up. She is now pregnant by another man. She doesn't have any of the 3 kids. Her parents have them. He had quite a bit of contact at first but they (grandparents) made it more & more difficult and uncomfortable. They wouldn't even allow us to hold her saying they only held her during feeding and an unspecified time at night. Thus I haven't seen her since she was a few months old. He has seen her a few times since, and then in Jan. he went to dfacs and asked them to go with him, they told him they would 1 time and then it was up to him. He went then and several other times but again it was getting more & more difficult. He is afraid for us to go alone for fear that they will make up something about him as they have in the past. They are filing for perm. custody and named him as the alledged father in the papers. Claiming he hasn't visited in a year. We have Very little extra money is there anything to do? Thanks

Re: Biological father wants to establish paternity

Your son needs to respond to the lawsuit filed by the mother. If your son wants custodial rights, then it is good that they contending that he is the father. Once that is established, he can sue for custody, visitation, etc.
