Biological father vs legal father

My husband now is the biological father of my 2 boys. My ex-husband is their legal father. Does my husband now need DNA test to establish paternity or does he just need to sign a legimation form. My sons have my have my ex-husbands last name and we want to change that, also. How would we do that.

If you have the cooperation of all parties, depending on what court orders already exist (some may preclude you doing some things now), some form of a petition to correct a birth certificate and determine paternity may work (a spouse can't file a legitimization).
