A Biological Father wanting to legitimate his child!!

I'am the mother of a 9 yr.old girl,I married a man 16 days before her birth with the man having the knowledge that he was not the father we gave her his last name well, he is now her Legal father,and we are getting a divorce and her Biological father wants to legitimate his self, He has already proven the DNA, My ex is refusing to let him, They are saying that after 7years there is no way that any judge will let a man be legitimated,is this tru and if not how can we do this?

You are confused about the issue: the man doesn't legitimate himself; he seeks to legitimate the child. You should contact a local attorney familiar with family law.

If the biolgical father has established paternity, he should now file for legitimation. You can consent to the legitimation. If the husband's name is on the birth certificate it can be removed and the bioligical father's last name can be added and the child's last name can be changed to that of the biological father's. I suggest that he seeks a local attorney for assistance.
