Legal Question in Family Law in Georgia

How can my boyfriend get his daughter legitimized? The mother lives in Cherokee County, Georgia and she may or may not consent. Do you always need a lawyer to be able to file the paperwork? Will he need to get a paternity test first to show that he is the biological father? His name is on the birth certificate and she has his last name. Right now, he shares custody with his ex...they switch every other week because the daughter is only 3 and has not yet started school. Also, after the legitimation process...what are the chances that he could get custody of her full time or at least most of the time? What would he need to show in order to get custody?

He needs a lawyer. Custody is usually decided at the same time as everything else. Right now he shares nothing, as he has no legal right to see teh child without a legitimization (he's relying on the mother's good will).
