My boyfriend and I are not married,we are about to legatamize are 4 month old.If we were to split up would I be able to leave the state where I would be with family have a roof over my head and have a job.

Once he legitimates the child, the judge may place a 30 day move notice in the custody order. The 30 day notice requires the custodial parent to give notice of his/her intent to move. At that point, if the parent objects to the move, a motion to change custody/visitation can occur.
If this notice requirement isn't in the custody order, if you move without notice, the father can still seek custody or a change in visitation.
