Legal Question in Family Law in Georgia

My boyfriend & I recently had a baby 6 weeks ago. However, I do not want to be in a relationship with the father any longer. We currently live in my house. And our son has his father's last name.

1. Does my boyfriend have any legal rights to our son since we're not married?

2. What do I need to do legally to have him removed from my home?

As far as removing him, that depends on the written contract you have. If you live together with someone you have none of the remedies a married person has, so a contract is essential and it answers question 2 for you.

As for question 1 he must support the child until age 18. Depending on what a court does, he could win custody or visitation.

The father would have to legitimate the child. Once that is done, he can seek visitation and/or custody. However, you can seek child support from the father.
