Legal Question in Family Law in Georgia
My boyfriend and I have been together for almost 4 years, and living together for 2. We have my 3 children full time (ages 6, 8, and 10), and are fixing to fight his ex girlfriend for custody of his two children (ages 11 and 13) Question is...will the fact of us not being married diminish our chances of winning custody?

Most likely, yes (though it is not "our" chances, it is his chances). He has chosen a lifestyle that is not only criminal, most judges would likely see it as immoral and harmful to the children. That looks like it is the norm for your boyfriend, as perhaps he wants to avoid any legal obligations and commitments that come with marriage, so the Judge considers that as well for the bests interests of the children. Of course, we know nothing of the former girlfriend and her lifestyle.
Almost certainly it will diminish his chances a great deal. As Scott noted, it is not a lifestyle that most judges will find appropriate.
