Legal Question in Family Law in Georgia
My boyfriend's child is in the main custody of her mother. Her mother does not work, has not had electricity since mid May, has been arrested twice since the beginning of the year, once for burglary, and once for obstruction of an officer. She is now wanted for questioning for stealing electricity from a neighbor. The child has been staying with me and her father pretty much full time since the electricity was cut off. I met the child in January of this year and at that time she was 2 days away from failing. She has made a complete turn around. She has told me more than once that she wants to stay with me and her dad. She said her mom has never made her feel safe and protected. The child is ten and I know that she has been in the truck asleep while her mom burglarized houses and played the card machines in convenient stores. Her mom is also using drugs.
The main thing here would be for her mom to get herself together, but it does not appear she is going to do that. She has now sold the trailer that they had and is looking for somewhere in the country, but she has no job, no transportation, and the only income she has is the $650 per month child support she receives from the child's father.
The father is out with surgery right now and does not have enough income to get a lawyer. We have called the child abuse line over and over with no apparent resolution.
What else can we do to protect this child?

Has boyfriend legitimized child??
Both of might be able to file Emergency TRO in the name of the child (to protect child from its mother) and ask for temporary custody ASAP and ask that child support be changed
Superior Court Clerk in your county will help you and a TRO is FREE
No guarantees that this will work but at least it might get DFACS involved (tell Judge when you have emergency hearing what you ried to do to protect child, etc etc)
