breaking off an engagement

Who should get the ring if the engagement has ended? He broke it off because she has emotional problems and won't seek help after 2 years of trying to make it work.

My opinion is that an engagement is a conditional gift; i.e., the guy went out of pocket for the ring, most certainly because he thought the marriage was going to go through. Since it hasn't, she should give it back.

Since you asked who "should" get the ring, it would be my opinion the answer is easy in most situations -- the person who paid for it. That keeps the personal issues from turning to who "wins" or "loses" financially due to the marriage not happening.
