Legal Question in Family Law in Georgia

My brother is trying to legitimize his son. The child's maternal grandparents have permanent guardianship over the child. If he legitimizes can he gain custody of the child and who's consent do we need, the mother or the guardians?

You don't necessarily need anyone's consent if the child is biologically his; however, for an uncontested legitimation all you need is Mom's consent. By legitimating the child, the Father would have the same access rights as any other father. Sometimes by legitimating the issues of custody, child support, and visitation become issues, based on the needs and desires of the Father.
