Legal Question in Family Law in Georgia

My brother is 32 years old and wants to change his last name. The reason why he wants to change his last name is because he has my mom ex husband last name. Is there anyway he can get my mom last name instead of her ex husband. He ex husband did not sign my brother birth certificate. But my mom did sign using her marriage name and was still married but completely seperated at the time of his birth. He want to change his last name now because he is about to be married and dont want his kids and wife to have the last name of man he dont knw
