I have a case in which an attorney appeared in court on a day in which she states she had approved leave, however she states she wont appear for an emerg. hearing due to it being on another day which she has scheduled leave is that not a conflict since she set precedence by coming on a day that she already appeared on her leave time.

If you go into work on a vacation day, do you think that means that from that day forward you have waived (or "set precedence") any and all vacation time in the future?
Of course not.
Court rules require attorneys to seek, well in advance, approval for projected leaves, which can be for vacation, continuing education, medical reasons, family events, conflicts with other courts or other reasons. If the reason for the leave evaporates, a lawyer may be able to attend a case for which their absence was approved.
That obviously doesn't mean the attorney can never again take a vacation, attend CLE, etc. Would you want your employer to make you forego vacations for life if you happened to work one scheduled vacation day?
