Change in Custody

My son is going to be 12 soon. He has lived with his father since he was 2 (I agreed to give him custodial rights for our son's benefit). Fast forward to now...My son wants to come to live with me and I want for him to be happy. He is unhappy at his father's for many reasons; namely, his dad is away a lot due to long business hours and my son has a wicked step-mother who is mean to him while his father is not present. I have talked to his dad about this problem and he supposedly spoke to her about it, but no changes have been made. No one there has time for him and he is not allowed to be enrolled in sports or any after-school activities, he isn't taken on vacation with them (only pawned off on me when they feel like being alone..which is fine by me). I feel that him being here would provide a more stable home environment and I could make sure he has a normal childhood and that he gets to be involved with school activities and sports, etc..as well as just being a nurturing parent who would be able to be here with him in the evenings since my schedule is more flexible than his father's. We have a previous judgment (in 1997), but I don't know the best way to go about this situation. Please help.

Your best opportunity is to employ an attorney to handle this for you. Presumably, you will also want to seek support from your ex-spouse as well.
