Legal Question in Family Law in Georgia

Change of jurisdiction

I was divorce in Ohio 6 yrs ago, Moved to Ga about 5 years ago, went through a nasty child custody case, where I lost custody at first. All of this was done in Ohio. A year ago I regained custody of the children and we still reside in Ga. Ex keeps hauling me up to Ohio for piddley stuff like who gets to claim kids on taxes. How do I change jurisdiction to Ga.(home of childrens residency) Can the judge in Ohio decide NOT to give up jurisdiction just out of spite?

Re: Change of jurisdiction

This is a very generic answer because the answer would depend on exactly what was filed and by who, as well as reading your divorce papers.

What state has jurisdiction is in part a question of whether the original order or agreement indicated that the court retained jurisdiction (if so most things will continue there). So get a good Ohio lawyer to look at that for you. If it does not, then Georgia has jurisdiction over custody matters and your ex must file most things in Georgia, and a good Ohio lawyer could get those things dismissed.
