Name Change for minor child

do I need an attorney in order to have my 3 yr old son's last name changed to my last name?

While you do have the right to be your own lawyer, unless you get things exactly right, you may be unsuccessful and waste considerable time and money. The legal fees in most name changes are inexpensive (if you're in metro Atlanta, call me to discuss the case).

No. You can do it yourself if you know how to do it. I usually use the analogy of rebuilding a car engine. You can do that yourself, if you have the skill and experience to do that but most of us need to hire a mechanic.

Uncontested name changes are usually fairly simple but sometimes there are issues. You don't state why the child's name is different from yours and whether this will be contested by the father. I would suggest you contact an attorney for a consultation. As far as legal matters go, name changes are fairly inexpensive.

From you question I infer that you and the father have divorced. If that is the case, you can apply for the name change order you seek in the divorce case in the family court proceeding. Otherwise, I can't add to the answers of Mr. Holcombe and Mr. Ashman
