Name Change of Minor

I am wondering what I can do about changing my daughters last name. It has been a year since her father has contacted us, yet he sends a small amount of child support almost every month. I have tried to contact him, by all means, e-mail, phone calls, postal mail, leaving a letter on his door, and he refuses to contact me. His name is on the birth certificate, but we have no custody agreement what so ever. I am wondering if it is possible for me to petition without his consent, and for him to be served. I would love to be able to ask him personally, but he isn't cooperative. Please let me know if there is any other necessary information for you to give me a throrough answer.
