Legal Question in Family Law in Georgia

Name change

I have a nephew that i have had under legal guardianship since he was 3 months old...He is now almost 12 years old. He has only seen his natural mom 2 times and she likes it that way. I wish to adopt him legally but i dont have a lot of money to pay for a lawyer.My question is cant we do our own adoption as one would do their own divorce? If not, how can i legally change his last name to mine.

The short answer (i.e., without teaching you how to practice law) is that yes, you can do the adoption yourself. Check with your local clerk of Superior Court to see if they can help.

You could, but even the simplest adoption takes a good deal of paperwork. In this case you will have to terminate the parents rights. You haven't mentioned the father and he will have to be considered also. Contact Georgia Legal Services to see if they can help or check with your local bar association to see if they might offer some assistance.
