Legal Question in Family Law in Georgia

change

tow months ago my husband started using illegal drugs. I had a restraing order placed against him due to he was stealing items from my residance to support his habit. He has now sought treatment and is now in couseling, he has requested for me to go to couseling with him to help support emotionally. He has changed and is now working and seems to be on the right track. I am thinking of recending the restraining order, how do I go about it. If I decide to go to couseling with him does this automatically terminate the order? Can anyone but myself enforce the restraining order? My mother does not feel I should ever trust him and says she will have him arrested, she lives next door to me but she is not a part of the restraing order.

Re: change

The restraining order is the judge's order to him, not your order. So, you really can't consent for the judge, technically. You would have to file a motion in court to modify the existing FV or other domestic order. Other parts of your quesiton can only be answered by reviewing the applicable order. Anybody witnessing a violation of a court order, or a crime, is within their rights to report it to the police, even if it is not their own rights being violated.

Contact an attorney if you really want a modification. My information is available on this site.
