Legal Question in Family Law in Georgia

Change of Venue in Modification of Custody/Visitation

I am a mother living without physical custody of my children. My ex husband and our chidren reside in Georgia and I reside in NC. I am seeking a reversal of custody or at minumum a modification of visitation. I attempted a modification of visitation in Georgia a few years ago and was denied the summers with my children because ''I was a working mother and my exhusband did not want to let the children spend the summer with me because he claimed that there are more daylight hours in the summer and he could spend more quality time than I could with the children'' I was awarded 3 weeks visitation. The court system in the county in which he residesd is in my opinion (and many others) a ''good old boy'' county. I want to know if there is a way to request a change of venue to have the case heard in NC...the state in which I reside. Can someone help me find a loop hole?

Re: Change of Venue in Modification of Custody/Visitation

It is highly unlikely that you can move this custody case to NC from GA. Every state has adopted laws that are against changing the jurisdiction of custody cases. Since one parent (& particularly the parent who has custody) resides in GA, you're pretty much stuck with dealing with that GA court. My best advice is to get a good ole boy lawyer in that county in GA to represent you. Good luck!
