Legal Question in Family Law in Georgia

Changing your name in Georgia

My husband would like to go back to his birth name ( the last name of his biological father, his Mom's first marriage )He was legally adopted by his Step father. How do we both go about changing our names ? Does the State of Georgia require court documents to change your name ? His stepfather is listed as his father on his birthcertificate. Can we get a copy of the original, or has it been replaced by the new one and erased ? Thanks !

In Georgia, a petition for a name change must be filed in order to change your name. The petitions may be obtained at the Fulton or Dekalb County Family Law Centers. The process is fairly simple and the packets contain step by step instruction to assist you in the process. The costs total no more than $150.00 to complete the process pro se. However, if you find the packets difficult contact an attorney who practices in this area.

Don't worry about the birth certificate. But, yes, he will need to file a petition in superior court. The procedure is described in the GA code beginning with section 19-12-1. You can check it out at http://www.ganet.org/services/ocode/ocgsearch.htm
