changing a minor's name

I'm 17 yrs. old and I would like to change my last name to my step-father's. The problem is that my biological father will not consent to the process. My biological father has signed his parental rights away, so would this allow my family and I to by pass the law of having both parents sign a a consent form for my name change?

A parent cannot "sign his rights away" so you may be mistaken as to his status. Only a judge can terminate rights, and, absent abuse (or adoption) that's rare.

The answer is real simple. File on your 18th birthday. Neither parent has any say so at that time. Call me then and I would be glad to discuss details with you.

Consult with a local attorney and then file your petition. Your father can file an objection, which will be considered by the court; however, he cannot automatically prevent the name change.
