chaning a minors 3 last names

My daughter was married to Mr Smith a daughter was born under the name of Smith..Now we find the child's bio-father is Jones..My daughter divorced and later remarried Mr Wright..Now Mr Jones has been battleing with my daughter in court..Child support, custody etc...Mr Jones does see his daughter and pays support here/there..My maiden name is Wright and my daughter would like to change the baby's name from Smith to Wright without interferance with Mr Jones. Can it be done. Mr Smith is out of the pic and the country. Mr Jones lives in another state...My grand daughter believes her last name is wright. At one point the CA judge had my grand flying every month for visitations with the bio father..Mr wright would love to adopt her but know Mr Jones would never let that happen just out of spite...Please help

Both parents have a say-so as to a child's name, so in any change the father needs to be served or consent. If the father objects, the issue will be decided at a trial. The fact your daughter gave false information on the birth certificate will likely complicate things and make it more expensive, and likely also means that the man listed on the birth certificate will need to be served. This may involve more than a name change (it also may be a petition to correct the birth certificate).
