child abandonment

i have 3 year old son his father hasnt contacted us in two years and has never helped finacially. now he is trying to get custody can i file for abandonment and if so how di i do this and will his rights be severed?

Abandonment is a criminal proceeding to collect child support. When a person goes one month without paying support they can be prosecuted.

Except in adoptions and in cases of abuse, there is no such thing as severing parental rights. In fact, as I am sure your lawyer has told you (and if you are in a custody case you need counsel), the quickest way to can get the judge mad at you and weaken your case is to argue against the other parent seeing a child. Discuss this with your attorney.
